Terms of Service

Ariumm (“we”, “us”, or “our”) operates the website https://www.ariumm.com (the “Site”), along with associated emails, newsletters, guides, and services (collectively, the “Service”). These Terms of Service (“Terms”) govern your access to and use of the Service.By accessing or using the Service, or by clicking “I agree”, subscribing, or otherwise indicating your acceptance, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. About Ariumm: Ariumm is a mental wellness newsletter service that delivers short, practical, evidence-informed emails and resources to support everyday emotional wellbeing and personal growth. The Service is provided for general informational and self-care purposes only. Ariumm is not a substitute for professional medical advice, diagnosis, therapy, or treatment. We do not provide clinical mental health services. If you are experiencing a mental health crisis, please contact a qualified healthcare professional or your local helpline immediately (e.g., Lifeline Australia 13 11 14).

2. EligibilityYou must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

3. Accounts and Subscriptions

• Free Offerings: The 7-day reset guide and certain emails are provided at no cost.

• Paid Subscriptions (Ariumm Core): Paid plans are billed on a recurring basis. You authorise us (via our payment processor) to charge the payment method you provide on the agreed schedule.

• Cancellation: You may cancel your subscription at any time through your account settings or by contacting hello@ariumm.com. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods unless required under Australian Consumer Law.

• Refunds: We offer refunds on a case-by-case basis. Australian Consumer Law guarantees apply where services are not provided with due care and skill or do not meet the guaranteed standards.

4. Payments and BillingPayments are processed securely by Stripe. We do not store full credit card details. You are responsible for providing accurate billing information and updating it promptly. If a payment fails, we may suspend your access until payment is received. All prices are in Australian Dollars (AUD) unless otherwise stated and include applicable taxes.

5. Intellectual PropertyAll content provided through the Service — including emails, guides, articles, tools, reflections, graphics, and other materials — is owned by Ariumm or its licensors and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the content solely for your own personal, non-commercial wellbeing purposes. You may not copy, reproduce, modify, republish, distribute, sell, or create derivative works from any Ariumm content without our prior written consent.

6. User Conduct and Acceptable UseYou agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.

• Share your subscription access or forward paid content to non-subscribers.

• Scrape, crawl, or extract content from the Service at scale.

• Introduce viruses, malware, or other harmful code.

• Harass, abuse, or interfere with other users or our operations.

• Attempt to gain unauthorised access to any part of the Service.

We reserve the right to suspend or terminate your access if we reasonably believe you have breached these Terms.

7. Third-Party ServicesWe use the following third-party services:

• Mailchimp – to manage email delivery and subscriber lists.

• Stripe – to process payments.

• Framer – to host and build the website.

Your use of these services is also governed by their respective terms and privacy policies. We are not responsible for the acts or omissions of these third-party providers.

8. Privacy and Data ProtectionYour privacy is important to us. We collect and process personal information (primarily your email address and subscription preferences) in accordance with our Privacy Policy and the Australian Privacy Principles. By using the Service you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. We do not sell your personal data.

9. Disclaimers and No WarrantiesThe Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any content will produce specific results. Mental wellbeing is highly individual. Results vary, and Ariumm makes no guarantees regarding outcomes from using the Service.

10. Limitation of Liability To the maximum extent permitted by law, Ariumm and its officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability to you shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.

11. IndemnificationYou agree to indemnify and hold Ariumm harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your breach of these Terms or your use of the Service.

12. Changes to the Service or TermsWe may update or modify the Service or these Terms from time to time. We will notify you of material changes by email or through the Site. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

13. TerminationWe may terminate or suspend your access to the Service at any time, with or without notice, for any reason. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (e.g., Intellectual Property, Limitation of Liability, Indemnification) will continue to apply.

14. Governing Law and JurisdictionThese Terms are governed by the laws of the State of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales to resolve any dispute arising from these Terms or the Service.

15. Miscellaneous

• If any provision of these Terms is held invalid, the remainder shall continue in full force.

• These Terms constitute the entire agreement between you and Ariumm regarding the Service.

• No waiver of any breach shall constitute a waiver of any other breach.

• We may assign these Terms without notice; you may not assign without our prior written consent.
